According to Law N° 91-63 of 29 July 1991, relating to health organisation, and Decree
n° 2002-846 du 17 avril 2002, defining the classification criteria for public health structures, ‘Public health Institutions’ refer to a legal category of public health structures that are different from Public Industrial and Commercial Institutions (EPIC) and Administrative and Non-administrative Public Institutions:
a. Public Health Institutions (EPS) are regulated by the Code of Commerce, with some exemptions adapted to their nature, whereas other public health structures are regulated by the Code of Public Accounting, thus enabling more flexibility in procuring input and establishing relations with suppliers, as well as an alleviated supervision.
b. EPSs are provided with a deliberative Board of Directors, bringing together representatives of the supervisory body, service buyers, local authorities, consumers and private physicians.
c. The modalities for setting equipment budget and staff management are the same for all public health structures. For EPSs, the estimated operating and investment budgets, as well as the related financing plan, are established according to the objectives and estimated activities, as defined by the programme contract established by the supervisory body and EPS, and which determines the human and material resources that the institution must have to fulfil its mission.
d.
EPSs may contract loans following the agreement of MF and MSP, unlike other SSPs. Practically, such possibility has never arisen in any ESP.
As regards mission and jurisdiction, EPSs are ‘health institutions with a university education’ invested, for the same reasons as any public health structure, with missions of medical and paramedical training, and scientific research. Their main mission is to provide highly specialised health care while contributing to graduate and postgraduate education in medicine, pharmacy and dental
medicine.
Polyvalent general institutions, such as Charles Nicolle Hospital, La Rabta Hospital in Tunis, the two hospitals in Sfax, and Fattouma Bourguiba Hospital in Monastir.
Specialised institutions by patient population (Children’s Hospital of Tunis), pathology (Salah Azaiez Institute of Cancerology, Institute of Nutrition and Food Technology…) or medical specialty (Razi Hospital of Manouba, Institute of Ophthalmology)
